UK Terms and Conditions – Eligibility to Enter

1. The IVOMEC® Super Competition (the “Competition”) is open to all livestock farmers residing in the UK aged 18 years or over.

2. The Competition is not open to employees or agencies of Merial Animal Health (the “Promoter”), their immediate families, or anyone else connected to the Competition.

3. Entry into the Competition will be deemed to constitute acceptance of these terms and conditions. The Promoter reserves the right to refuse entry, or refuse to award the prize to anyone in breach of these terms and conditions.

Entering the Competition

4. To enter the Competition, you must submit (a) a completed entry form. Entries must be the original work of the author and must not contain any content that is defamatory, libellous, racist, homophobic, derogatory, obscene, sexist, illegal, and/or otherwise inappropriate.

5. Entry forms can be found and submitted, together with your success story, instore at any participating store in the UK, or online on the Competition website at www.ivomecsuper30.vettimes.co.uk. Only one entry per person is permitted and no purchase is necessary.

6. You own the copyright to your Competition entry as its author.  However, by submitting an entry to the Competition, you give the Promoter (a) permission for your entry to be published on the Promoter’s websites including but not limited to www.ivomecsuper30.vettimes.co.uk and on any social media account controlled by the Promoter including but not limited to Facebook and Twitter accounts, and you grant the Promoter a non-exclusive, royalty-free, worldwide licence to use and publish your Competition entry in electronic format and hard copy (including in regional and national press) for purposes connected with the Competition, and to adapt the entry to enable such publication (including to crop or otherwise edit it for such purposes), and you hereby irrevocably waive, for the benefit of the Promoter, all moral rights in the entry to which you are entitled, and (b) the right to use your name for the purpose of identifying you as the author of your entry and/or as a winner of the Competition.

7. The Competition opens for entries on 18 May 2017 and closes at 23:59 on 30 September 2017. Entries received outside this time period will not be considered. The Promoter reserves the right in its absolute discretion to extend the closing date where the entries received are of insufficient quality.

Picking the Winners

9. A panel of judges, including at least one member who is independent of the Promoter, will select, from all valid entries received in accordance with these terms and conditions, one winning entry from each region, i.e. from Scotland, Wales, Northern Ireland, South West England, North West England and East England.

10. The Promoter reserves the right to exclude any entries if the Promoter, at its sole discretion, believes that there has been an attempt to manipulate or tamper with the voting process (including, without limitation, offering or receiving any incentive for voting and/or automatically generated voting).

11. A panel of judges, including at least one member who is independent of the Promoter, will select, from the six Regional Winners, one overall winner (the “National Winner”).

12. When choosing the Regional and National Winner, the judges will consider the originality and aptness of the entries, as well as considering the general quality of the writing. The decision of the panel of judges (acting reasonably) will be final and no correspondence will be entered into. Entrants must not contact, or try to contact, the judges in any way in connection with the Competition, or otherwise try to influence the judges’ selection of the National Winner.

The Prizes

14. The Regional Winners will each receive a maximum of two IVOMEC® Super vests. The National Winner will receive, an Ifor Williams TA510 Livestock trailer and an invitation for the winner and a guest to attend the Food and Farming Industry Awards Dinner at the House of Commons in London in December 2017 (dates to be confirmed). The Promoter accepts no responsibility for any costs associated with the prizes that are not expressly included in the prizes, including but not limited to the cost of travel to and from any applicable events.

15. The prizes are non-exchangeable, non-transferable and there is no cash alternative.

16. The Promoter reserves the right to substitute the prize with an alternative of a similar nature and value in the event that the original prize offered is not available.

Announcement of Winners

17. The Regional Winners will be announced on 21 October 2017 and the National Winner will be announced on 28 October 2017. The Promoter’s regional Area Business Development Manager or a member of the judging panel will contact the winners as soon as practicable following the announcements, using the telephone number or email address provided with the Competition entry to give details of how to claim their prize.

18. If a winner does not claim the prize within 14 days of being notified, or if a winner is not available to take up the prize or is disqualified, then the prize will be forfeited and the Promoter shall be entitled to select another winner in accordance with the process described above.

19. The prizes will be sent to the winners by post within 14 days of acceptance.

20. The winner’s names and counties can be obtained after 28 October 2017 by sending a stamped addressed envelope to the Promoter at Merial Animal Health, PO Box 327, Harlow, Essex, CM19 5TG.

Publicity

21. The winners may be required to take part in promotional activity related to the Competition and the winners shall participate in such activity on the Promoter’s reasonable request.

22. The winners consent to the use by the Promoter and its related companies, for an unlimited time, of the winner’s image, photograph, name, Competition entry and testimonials for publicity purposes (in any medium, including still photographs and films, and on the internet, including any websites hosted by the Promoter and its related companies) and in advertising, marketing or promotional material without additional compensation or prior notice and, in entering the Competition, all entrants consent to the same.

Liability of Promoter

23. Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winners or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.

24. The Promoter reserves the right at any time to modify or discontinue, temporarily or permanently, this Competition with or without prior notice due to reasons outside its reasonable control. The Promoter shall not be liable for any failure to comply with its obligations relating to this Competition where the failure is caused by something outside its reasonable control. In the event of any dispute regarding the Competition, the decision of the Promoter shall be final and no correspondence or discussion shall be entered into.

25. The Promoter will not be liable for technical, hardware, or software failures of any kind or lost or unavailable network connections that may limit or prohibit an eligible entrant’s ability to participate in the Competition or that may limit or prohibit the voting process.

26. This Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook.

Data Protection

27.  By entering the Competition, you agree that any personal information provided by you with the Competition entry may be held and used by the Promoter or its agents and suppliers to administer the Competition and for the purposes outlined in paragraphs 8, 9, 17, 20, 21 and 22.

Governing Law and Jurisdiction

28. The Competition and these terms and conditions will be governed by English law and entrants to the Competition submit to the exclusive jurisdiction of the English Courts.

6. The Promoter will not be responsible for any entries that are lost, delayed, misdirected, corrupted or otherwise, or cannot be delivered or entered for any technical or other reason. Proof of delivery of the entry is not proof of receipt by the Promoter.
